Employment-Based Green Cards

Employment-based green card is the immigration status that allows the employee to stay in the U.S. permanently without requiring sponsorship.

PRIORITY WORKER

EB-1 Eligibility

Individual with extraordinary ability, who are nationally or internationally recognized in the field of science, arts, education, business or athletics.
Outstanding professors or researchers, who have 3 years of experience in research or teaching
Multinational managers or executives, who are employed with non-U.S. based entity of the U.S. petitioner for 12 consecutive months in the last three years.

THE PROCESS

Filing Green Card in EB-1

Individuals can, themselves, file petition for extraordinary ability category under EB-1. However, the employer must file the petition for an employee to prove their outstanding professors or researchers eligibility, or multinational manager or executive eligibility.

EB-2 Eligibility

Employees with an advanced degree (master's or Ph.D.)
Employees with bachelor's degree + 5 years of post-bachelor's experience

Individuals with exceptional ability in science, art or business
Individuals whose work benefits the national interest of the U.S.

THE PROCESS

Filing Green Card in EB-2

Employer has to start the green card process for their employees by filing the PERM. If applying for National Interest Waiver, the employer has to demonstrate that it is in the national interest of the U.S. to waive the requirement of PERM.

PERM

Labor Certification

Seek wage approval and advertise position. This process can take anywhere from 3 - 6 months.

I-140

Petition for alien worker

File proof of eligibility and get a decision in 15 business days with premium processing.

I-485

Change of status

File for change of status, Employment Authorization and Advance Parole documents. Timeline varies by country of birth.

SKILLED or OTHER WORKER

EB-3 Eligibility

Professional, defined as someone with a bachelor's degree
Skilled worker, defined as someone with at least two or more years of experience, with or without a bachelor's degree

Unskilled or other worker, defined as someone with less than two years of training 

THE PROCESS

Employer has to start the green card process for their employees by filing the PERM. There is no category under EB-3 that qualifies for National Interest Waiver and thus no PERM requirement.
